Welcome to Baleen. These Terms of Service ("Terms") govern your access to and use of the Baleen mobile application and related services (collectively, the "Service") provided by Baleen ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you represent that you are at least 13 years old and agree to comply with these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Baleen is a mobile application that helps users identify allergens and ingredients in food products by scanning barcodes. The Service provides:

  • Barcode scanning to identify food products
  • Ingredient and allergen information lookup
  • Personalized allergen alerts based on your preferences
  • Scan history and product tracking

THE SERVICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

To use certain features of the Service, you must create an account. You agree to:

You may not reproduce, distribute, modify, or create derivative works of any portion of the Service without our express written consent.

7. Third-Party Data

The Service incorporates product and nutrition data from third-party sources, including the USDA FoodData Central and Open Food Facts databases. We do not guarantee the accuracy, completeness, or timeliness of this data. Third-party data is provided "as is" and subject to the terms and licenses of the original data providers.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
  • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claims arising from the Service shall not exceed the amount you paid us, if any, in the past twelve months.

9. Indemnification

You agree to indemnify, defend, and hold harmless Baleen and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may also delete your account at any time through the app settings.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Effective Date." Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in San Francisco County, California.
